March 6 - There was fantastic news for online gambling today when the legal arm of the European Union handed down a landmark ruling in a case between the Italian government and a British-based bookmaking firm, finding in favor of the latter.
The decision delivered a huge blow to Europe`s state-run gambling monopolies, and clearly indicates that protectionist attempts to prevent intra-country gambling in the European Union are not legal.
Many EU member countries have sought to prohibit online gambling in an attempt to protect state-run lotteries and local gambling interests. But the EU is based on open trade between those member countries and specifically mentions the freedom to provide services. That was the core argument of the Italian bookies who were operating shops without a gaming license from the Italian authorities.
They claimed that they did not need an Italian license because the shops already had a valid UK gaming license, and now the European Court of Justice has concurred.
The ruling had an immediate impact with share prices of online gambling companies Bet And Win, 888, and Partygaming all rising sharply on the news.
There is now an important legal precedent for online poker, sports betting, and casino operators, and one presumes that they can now operate freely throughout Europe provided that they are legally licensed and operate within the European Union.
