Online Gambling Giant To Contest Loss Of Domain Name - 09-27-07


September 28 -  Bodog, the  online casino, sportsbook and poker giant will apparently challenge the rulings made against them in a Nevada court last month. The ruling resulted in a default judgment and Bodog lost its domain name and was slapped with a $48 million fine.

The company has since changed its domain to BodogLife.com, and reports that the URL change had far less effect on its business than expected..

1st Technology claimed $48 million in "damages" and as Bodog did not turn up for the court case, a default judgment was handed down. The patent in question is called the 'Method and System for Interactively Transmitting Multimedia Information over a Network Which Requires a Reduced Bandwidth while operating in the US'. There has been wide spread speculation over the assistance from the US DoJ in this case, as it makes further moves to take action against offshore gaming companies targeting US customers.

Calvin Ayre, Bodog's Canadian founder and CEO, said that Bodog Entertainment SA, as a Costa Rican company has no physical presence in the USA nor does it hold any assets there.

The Bodog.com domain name was seized as an asset, and Ayre argues that a domain name is not an asset under patent law and that the domains held by his company were held on behalf of other entities. He further argues that domain names are a part of the world community according to the Internet Corporation for Assigned Names and Numbers (ICANN), which places in doubt whether or not they could be seized..

Bodog's primary defense however will be that it was not properly served on in the Nevada, which will result in the default judgment being invalid, and which will no doubt result in a few red faces.

Ayre stated that nobody in or related to Bodog got served by the Nevada authorities.
